Consent
If you want to conduct business with us electronically, we need your consent. By checking the box, you agree to receive disclosures from us, including our service providers, agents, successors, assigns, and other third parties acting on our behalf, electronically through this website or by email under the terms of this Consent to Electronic Communications. By consenting to electronic communications, you agree that we may deliver electronically any and all communications concerning our services, agreements between you and us, and any disclosures required by federal or state law (the "Disclosures").
The Disclosures may include disclosures pursuant to: (1) this Disclosure and Consent; (2) any Unsecured Promissory Note with us and any related Unsecured Promissory Note application, Truth in Lending Disclosure or Arbitration Clause; (3) disclosures and Terms of Use on our website; (4) any electronic payment authorization you give us; (5) our privacy policies and notices, including notices under the California Consumer Privacy Act; (6) any adverse action notice, risk-based pricing notice or other disclosure required by federal, state or local law; (7) letters, notices, statements or alerts regarding the foregoing that we provide to you; and (8) any updates to previously listed agreements, policies, disclosures, authorizations, or other notices. Your consent applies not only to the immediate transaction, but also to future transactions between you and us.
System Requirements
To electronically receive, view, or save and/or print the Disclosures, you must have: (1) a personal computing device with Internet access; (2) a widely-used, recent-generation web browser (for example, Microsoft Edge, Apple Safari, or Mozilla Firefox); (3) a widely-used, recent-generation portable document file reader (for example, Adobe Reader); (4) an email address; and (5) either a printer, hard drive, or other storage device.
You understand that Disclosures may be delivered to you through our website or your account on our platform or sent to you by email or text message containing attachments in pdf format or via links to documents on our web site. We anticipate that any emails we send you may have file sizes up to 20MB (but not larger). You should make sure that any spam filter you use is set to allow receipt of messages from support@loanterra.com.
You represent that you have the hardware, software, email address, and email capacities described above.
Updating Your Contact Information
If the information you have supplied us for contacting you electronically changes, it is your responsibility to notify us of your new contact information by sending an email to backoffice@loanterra.com or by updating your contact information by logging into your account online.
Requesting Paper Copies
You may request from us a paper copy of any record provided or made available electronically to you by us by contacting loanTERRA at support@loanterra.com. You will have the opportunity to print out and retain a copy of all the Disclosures you review or sign at our request through the LoanTERRA customer portal, you may access the documents for a limited period of time (usually 30 days) after such documents are first sent to you. After such time, if you wish for us to send you paper copies of any such Disclosures, you will be charged a $1.00 per-page fee.
To request delivery from us of paper copies of the Disclosures previously provided by us to you electronically, you must send us an email to support@loanterra.com within 180 days of the date of the Disclosure, specifying in detail the Disclosure you would like to receive and provide us with sufficient information to identify the Disclosure you are requesting in the body of such request and you must provide your full name, mailing address, email address, and telephone number.
For the avoidance of doubt, requesting a paper copy of any Disclosure, in and of itself, will not be treated as withdrawal of consent to receive Electronic Communications.
Withdrawal of Consent to Electronic Communications
You may withdraw your consent to receipt of electronic communications at any time by emailing support@loanterra.com and submitting your request. Please provide us with your name, address, and project or loan number in any such request. If you withdraw your consent, you will not be able to continue to do business with us electronically which will result in the termination of your access to our services, but this will not affect any Disclosures provided to you electronically prior to your withdrawal.
